A European Commission public consultation on the legislative framework for tobacco products is underway and will accept responses until May 16. The consultation—the second part of a process that began in 2022—launched in late February. While the consultation seeks comments on all tobacco products, it is clearly aimed at introducing harsher regulation for e-cigarettes and other low-risk nicotine products. Comments solicited will be used to shape changes to the Tobacco Products Directive (TPD) and possibly the Tobacco Advertising Directive. The consultation itself was deliberately written to elicit anti-vaping responses, according to sources quoted in a Vejpkollen story. But it is the only tool European vapers and other nicotine product users have available to prevent the adoption of prohibitionist vaping laws.

The Columbus, Ohio City Council voted Monday to prohibit sales of flavored vaping products and tobacco, making it one of just a few major cities between the east and west coasts to do so. The flavor ban passed unanimously (7-0), despite strong opposition from vaping businesses and other local retailers.The ordinance will take effect Jan. 1, 2024, assuming Mayor Andrew Ginther approves it. He has already indicated strong support for the law.

The Macau Legislative Assembly today approved the first draft of a bill that will, if passed, ban sales of all vaping products in the wealthy Chinese semi-autonomous region. The proposed law would prohibit manufacture, distribution, sale, import, export, and transport in and out of Macau. The Macau Executive Council announced in January that it planned to propose a sales ban this year. On May 27, the government presented its draft bill, which includes proposed fines of 4,000 Macanese pataca (MOP) (about $500 U.S.) for individual offenders, and fines from 20,000-200,000 MOP ($2,500-25,000) for businesses.

The Philippines Senate today passed a bill that would legalize and regulate vaping and heated tobacco products, and eliminate the Philippines FDA’s authority over the products. The Vaporized Nicotine Products Regulation Act (SB 2239) was approved by a vote of 19-2, with two senators abstaining.The Philippines House of Representatives overwhelmingly passed a similar bill in May. The two bills will now go to a conference committee where they will be reconciled, and both houses will vote on the final version. Then the unified bill will go to President Rodrigo Duterte to sign into law or veto (if he takes no action, the bill automatically becomes law after 30 days).

The Netherlands will postpone its flavor ban for six months,according to the Dutch vape trade association Esigbond. The decision to delay implementation of the law, which had been scheduled to take effect July 1, was made by the Dutch cabinet (Council of Ministers).The flavor ban, approved last May by the cabinet, will only allow sales of tobacco-flavored vaping products. To enforce the restrictions, the National Institute for Public Health and the Environment (RIVM) created a list of approved flavorings, which Esigbond says was based on the list produced by Health Canada for its planned flavor ban. Esigbond says the list included two flavorings—isophorone and pyridine—known to be carcinogenic.
