Countless health entities such as Public Health England (PHE) promote such alternative products as smoking cessation and/or harm reduction tools.A number of studies have pointed out that in countries where vaping rates have increased, smoking rates have decreased, and vaping rates seem to decreasing aswell. In fact, a 2020 US survey indicated that only 20% of high school students and 5% of middle school students have reported recently using e-cigs. This is a significant drop in comparison to the 28% and 11% reported in 2019, with the percentages suggested to equate to a drop of 1.8 million, from 5.4 million to 3.6 million.

On June 30, almost a year after Panama’s National Assembly passed legislation banning vape product sales, Panamanian President Laurentino Cortizo gave his assent to the bill. The new law prohibits sales and importation of all vaping and heated tobacco products, with or without nicotine. The law does not criminalize use, but bans vaping in any place where smoking is not allowed. The new law also prohibits internet purchases, and gives customs officials authority to inspect, detain and seize shipments. Resellers are allowed to import banned products meant for export to third countries, according to La Prensa.

The FDA has authorized marketing of two vaping devices and tobacco-flavored refills made by Logic Technology Development LLC, the vape product arm of Japan Tobacco International (JTI). These are the only vaping products authorized by the agency since Vuse Solo became the first in October 2021—more than five months ago. The FDA gave nods to the Logic Power and Logic Pro, and tobacco-flavored refills for both. Premarket Tobacco Applications (PMTAs) for both devices’ menthol refills remain under FDA review, as have nearly all menthol applications submitted to the agency. Logic submitted PMTAs for the Power and Pro devices and refills in 2019. They were among the earliest submissions—more than a year before the Sept. 9, 2020 PMTA submission deadline.

The European Commission plans to impose a minimum excise tax on vaping products for all European Union member states. The new tax would be part of the revised Tobacco Excise Directive (TED), which could also include a doubling of the minimum tax on cigarettes and the first tax on heated tobacco products.

A European Commission public consultation on the legislative framework for tobacco products is underway and will accept responses until May 16. The consultation—the second part of a process that began in 2022—launched in late February. While the consultation seeks comments on all tobacco products, it is clearly aimed at introducing harsher regulation for e-cigarettes and other low-risk nicotine products. Comments solicited will be used to shape changes to the Tobacco Products Directive (TPD) and possibly the Tobacco Advertising Directive. The consultation itself was deliberately written to elicit anti-vaping responses, according to sources quoted in a Vejpkollen story. But it is the only tool European vapers and other nicotine product users have available to prevent the adoption of prohibitionist vaping laws.
