A bill passed this week in New Jersey will require vape shops and most tobacco retailers to keep nicotine gum or other nicotine replacement therapy (NRT) products in stock and available for sale. The bill exempts cigar shops from the requirement.If the bill becomes law it will require “any entity that sells, offers for sale, or distributes for commercial purpose any tobacco product to maintain a stock of, and offer for retail sale, at least one type of nicotine replacement therapy drug, device, or combination product that has been approved by the federal Food and Drug Administration for cessation of tobacco use.”

While public health advocates are frustrated as most PMTAs remain pending despite a September deadline set by the US District Court in Maryland, several anti-tobacco groups keep pressuring the agency to flat out deny applications for flavoured vaping products. With regards to the newly approved Logic Technology products, the FDA said that given that they are just tobacco flavoured, they may be less appealing to teens and could probably be of benefit to adult smokers seeking an alternative to traditional cigarettes. The agency added that their smoking cessation benefits to adults likely outweigh the risks to young people. The FDA has authorized marketing of two vaping devices and tobacco-flavored refills made by Logic Technology Development LLC, the vape product arm of Japan Tobacco International (JTI). These are the only vaping products authorized by the agency since Vuse Solo became the first in October 2021—more than five months ago. The FDA gave nods to the Logic Power and Logic Pro, and tobacco-flavored refills for both. Premarket Tobacco Applications (PMTAs) for both devices’ menthol refills remain under FDA review, as have nearly all menthol applications submitted to the agency. Logic submitted PMTAs for the Power and Pro devices and refills in 2019. They were among the earliest submissions—more than a year before the Sept. 9, 2020 PMTA submission deadline.
