While public health advocates are frustrated as most PMTAs remain pending despite a September deadline set by the US District Court in Maryland, several anti-tobacco groups keep pressuring the agency to flat out deny applications for flavoured vaping products. The FDA has authorized marketing of two vaping devices and tobacco-flavored refills made by Logic Technology Development LLC, the vape product arm of Japan Tobacco International (JTI). These are the only vaping products authorized by the agency since Vuse Solo became the first in October 2021—more than five months ago. The FDA gave nods to the Logic Power and Logic Pro, and tobacco-flavored refills for both. Premarket Tobacco Applications (PMTAs) for both devices’ menthol refills remain under FDA review, as have nearly all menthol applications submitted to the agency. Logic submitted PMTAs for the Power and Pro devices and refills in 2019. They were among the earliest submissions—more than a year before the Sept. 9, 2020 PMTA submission deadline.

The vaping products and more recently the heated tobacco products (HTP) provide alternatives for smokers since they are generally perceived to be less harmful than conventional cigarettes. However, it is crucial to compare the health risks of these different emergent devices, in order to determine which product should be preferred to substitute cigarette.

The Columbus, Ohio City Council voted Monday to prohibit sales of flavored vaping products and tobacco, making it one of just a few major cities between the east and west coasts to do so. The flavor ban passed unanimously (7-0), despite strong opposition from vaping businesses and other local retailers.The ordinance will take effect Jan. 1, 2024, assuming Mayor Andrew Ginther approves it.
