The Philippines Senate today passed a bill that would legalize and regulate vaping and heated tobacco products, and eliminate the Philippines FDA’s authority over the products. The Vaporized Nicotine Products Regulation Act (SB 2239) was approved by a vote of 19-2, with two senators abstaining.The Philippines House of Representatives overwhelmingly passed a similar bill in May. The two bills will now go to a conference committee where they will be reconciled, and both houses will vote on the final version. Then the unified bill will go to President Rodrigo Duterte to sign into law or veto (if he takes no action, the bill automatically becomes law after 30 days).

Three major British grocery chains have removed some Elf Bar disposable vapes from their shelves after the manufacturer admitted that products containing illegal features were distributed to some retailers. The smoking rate in 2022 among adult Americans dropped to its lowest rate since health officials began measuring it, according to survey results released yesterday. The decline came alongside an increase in the percentage of U.S. adults who vape. Preliminary full-year 2022 results from the National Health Interview Survey (NHIS) showed just 11.2 percent of adults smoked every day or some days. More than half as many surveyed adults, 5.8 percent, used vaping products every day or some days. In the fourth quarter of 2022, adult vaping prevalence reached 6.6 percent—the highest number since the NHIS added vaping to its survey in 2019. The results are estimates, and could be revised later. The NHIS is conducted annually by the National Center for Health Statistics (NCHS), a unit of the Centers for Disease Control and Prevention (CDC).

The Macau Legislative Assembly today approved the first draft of a bill that will, if passed, ban sales of all vaping products in the wealthy Chinese semi-autonomous region. The proposed law would prohibit manufacture, distribution, sale, import, export, and transport in and out of Macau.The Macau Executive Council announced in January that it planned to propose a sales ban this year. On May 27, the government presented its draft bill, which includes proposed fines of 4,000 Macanese pataca (MOP) (about $500 U.S.) for individual offenders, and fines from 20,000-200,000 MOP ($2,500-25,000) for businesses.The draft bill does not (yet) prohibit personal use or possession, but the ban on import and transport from China would make acquiring products impossible without breaking the law.

Taiwan’s national legislature (Legislative Yuan) banned e-cigarettes yesterday, passing the third reading of a series of amendments to the Tobacco Hazards Prevention Act. The new laws were first proposed last year by the country’s cabinet (Executive Yuan).Vaping products, classified as “tobacco-like products,” will be strictly prohibited, including sale, manufacture, promotion, import, and even personal use. The amendments will take effect a month after their publication by the government.
