The Los Angeles City Council on Wednesday passed an ordinance to ban the sale of the candy-flavored nicotine across the city.Officials said L.A. is now the most populous city in the nation to take flavored nicotine products, including menthol cigarettes, off store shelves. The council passed the motion with a 12-0 vote, garnering praise from health nonprofits like the American Heart Association and the American Lung Association.

Puff Bar vape, a popular disposable electronic cigarette that uses flavored synthetic nicotine, may face scrutiny now that the U.S. Food and Drug Administration has the authority to regulate synthetic, or lab-created, nicotine products. On March 11, a new federal spending bill was signed into law giving the FDA regulatory power over synthetic nicotine, also called tobacco-free nicotine. Previously, the FDA only had the power to regulate products containing tobacco-based nicotine. Many e-cigarette makers, including Puff Bar, used this loophole to continue selling their nicotine-based products without gaining direct approval from the FDA.

The United Kingdom will be announced vaping products as the smoking cessation medical products officially. The UK has long been a leader in endorsing the use of safer alternative nicotine products for smoking cessation, and as a result the nation has the lowest smoking rates ever recorded since cigarettes arrived on the scene decades ago.Back in 2017 the UK government’s document released last Summer, Towards a Smokefree Generation, A Tobacco Control Plan for England, encouraged different localities to develop their own tobacco control strategies, with a focus on e-cigarettes and other harm reduction or smoking cessation aides. The British Medical Association supports these developments and has suggested that e-cigarettes are licensed as medicine, allowing doctors to recommend them to smokers trying to quit.

The Macau Legislative Assembly today approved the first draft of a bill that will, if passed, ban sales of all vaping products in the wealthy Chinese semi-autonomous region. The proposed law would prohibit manufacture, distribution, sale, import, export, and transport in and out of Macau. The Macau Executive Council announced in January that it planned to propose a sales ban this year. On May 27, the government presented its draft bill, which includes proposed fines of 4,000 Macanese pataca (MOP) (about $500 U.S.) for individual offenders, and fines from 20,000-200,000 MOP ($2,500-25,000) for businesses. The draft bill does not (yet) prohibit personal use or possession, but the ban on import and transport from China would make acquiring products impossible without breaking the law.

The FDA has federal authority to regulate vaping products. In September 2020 the agency began reviewing Premarket Tobacco Applications (PMTAs), and has signalled it will not authorize flavored products without extraordinary evidence. Whether the agency will be successful creating an unwritten standard that eliminates legal flavored products (except tobacco and menthol) may be determined by federal courts. Most vape bans in the U.S. happen at the state and local levels. And while a few California cities—notably San Francisco—have banned sales of all vaping products, most American vape restrictions involve flavors and online sales. There are only a few of each, despite the large number of vaping bans that have been proposed in state legislatures in recent years—proof that grassroots opposition can stop bad legislation.
