Hong Kong residents who vape or use heated tobacco products (HTPs) will face a grim reality since this May. That’s when a ban on sales and importation of vapes takes effect, and the vape market will instantly shift from legal to illegal.Hong Kong retailers report that sales of vape products have surged in recent weeks, as desperate vapers try to stockpile products. But 90 percent of recently polled HTP users say they will return to smoking cigarettes after the ban takes effect.

European Union lawmakers are proposing to ban flavored heated tobacco products — a category that covers vaping — in a move they say is intended to protect the health of young people after a “significant” rise in sales of novel heated tobacco products. The EU has set itself a goal of creating a ‘tobacco free generation’, and having less than 5% of the population using tobacco by 2040, as part of a major anti-cancer drive.

The FDA has federal authority to regulate vaping products. In September 2020 the agency began reviewing Premarket Tobacco Applications (PMTAs), and has signalled it will not authorize flavored products without extraordinary evidence. Whether the agency will be successful creating an unwritten standard that eliminates legal flavored products (except tobacco and menthol) may be determined by federal courts. Most vape bans in the U.S. happen at the state and local levels. And while a few California cities—notably San Francisco—have banned sales of all vaping products, most American vape restrictions involve flavors and online sales. There are only a few of each, despite the large number of vaping bans that have been proposed in state legislatures in recent years—proof that grassroots opposition can stop bad legislation.

Countless health entities such as Public Health England (PHE) promote such alternative products as smoking cessation and/or harm reduction tools.A number of studies have pointed out that in countries where vaping rates have increased, smoking rates have decreased, and vaping rates seem to decreasing aswell. In fact, a 2020 US survey indicated that only 20% of high school students and 5% of middle school students have reported recently using e-cigs. This is a significant drop in comparison to the 28% and 11% reported in 2019, with the percentages suggested to equate to a drop of 1.8 million, from 5.4 million to 3.6 million.

The Bill proposes to exempt electronic cigarettes transported through Hong Kong via sea-air and land-air intermodal under a new part of the Import and Export Ordinance. Currently, the smoking regulations already provide exemptions for alternative smoking products that are transit articles or air transhipment cargo. The Hong Kong Special Administrative Region Government stated that it will establish a new regulatory system that will be managed, supervised and enforced by the Hong Kong Customs to strengthen the supervision of intermodal transportation of e-cigarettes, thereby reducing the risk of alternative smoking products entering the local market during intermodal transportation in Hong Kong . The bill will be introduced to the Legislative Council for consideration on March 29.
