There are growing concerns that the popularity of new and emerging Nicotine Replacement Therapies (NRTs) is leading to recreational use by people who do not smoke, and, in particular, youth under 18 years of age. Today, the Honourable Mark Holland, Minister of Health, is announcing that Health Canada is introducing new measures for NRTs through a Ministerial Order to reduce the appeal of, access to, and use of these products by young people for recreational purposes, ensuring access is restricted to adults who use these products to help them quit smoking.

NSW Health has seized more than $1 million worth of illegal e-cigarettes and liquids containing nicotine since January 2022. Since 1 October 2021, products containing nicotine are only available for people over the age of 18 when prescribed by a medical practitioner for smoking cessation purposes. These products are only available from an Australian pharmacy or via importation into Australia with a valid prescription. For all other retailers in NSW, the sale of e-cigarettes or e-liquids containing nicotine is illegal. This also includes online sales.

Most vape bans in the U.S. happen at the state and local levels.And while a few California cities—notably San Francisco—have banned sales of all vaping products, most American vape restrictions involve flavors and online sales. There are only a few of each, despite the large number of vaping bans that have been proposed in state legislatures in recent years—proof that grassroots opposition can stop bad legislation.
