Taxes on specific products—usually called excise taxes—are applied for various reasons: to raise money for the taxing authority, to change the behavior of those being taxed, and to offset environmental, medical, and infrastructure costs created by the use of products. A European Commission public consultation on the legislative framework for tobacco products is underway and will accept responses until May 16. The consultation—the second part of a process that began in 2022—launched in late February. Comments solicited will be used to shape changes to the Tobacco Products Directive (TPD) and possibly the Tobacco Advertising Directive. But it is the only tool European vapers and other nicotine product users have available to prevent the adoption of prohibitionist vaping laws.

The government of Thailand has rejected the efforts of one cabinet minister to legalize and regulate nicotine vaping products, and will instead reconfirm the country’s ban on sales and import of e-cigarettes. Thailand’s vape ban has been in place since 2014, and has resulted in notoriously overzealous enforcement.

Today, the Honourable Mark Holland, Minister of Health, is announcing that Health Canada is introducing new measures for NRTs through a Ministerial Order to reduce the appeal of, access to, and use of these products by young people for recreational purposes, ensuring access is restricted to adults who use these products to help them quit smoking.

On March 25th, 2022, the Northwest Territories announced that it’s ban on the sale of flavoured vaping products will take effect. This ban was intended to better protect the public and youth from vaping as “a significant health hazard… causing acute lung injury”, despite overwhelming evidence that these events were linked to illegal THC products purchased from the illicit market, not legal nicotine vape products.
