The Netherlands will postpone its flavor ban for six months, according to the Dutch vape trade association Esigbond. The decision to delay implementation of the law, which had been scheduled to take effect July 1, was made by the Dutch cabinet (Council of Ministers). The flavor ban, approved last May by the cabinet, will only allow sales of tobacco-flavored vaping products. To enforce the restrictions, the National Institute for Public Health and the Environment (RIVM) created a list of approved flavorings, which Esigbond says was based on the list produced by Health Canada for its planned flavor ban. Esigbond says the list included two flavorings—isophorone and pyridine—known to be carcinogenic.

The vaping regulation bill passed by the Philippines legislature in January has become law. The legislation makes the Philippines one of very few Asian countries with reasonable vaping regulations intended to benefit people who smoke or would smoke if vapor products weren’t available. The most important aspect of the law is that it legitimizes vaping as a strategy to help smokers reduce or eliminate their health risks. There are more than 16 million Philippines citizens who smoke. Offering them a government-approved, regulated alternative could save millions of lives.

The government says it is unlikely to follow Australia's vaping crackdown - at least this term. The Australian federal government has announced tough new measures in an effort to stop young people vaping. Health Minister Mark Butler said the bright colours, range of flavours, and accessibility had turned a generation of young people into nicotine addicts. "Vaping was sold to governments and to communities all around the world as a therapeutic product to help long term smokers quit. It was not sold as a recreational product, and in particular, not one for our kids. But that is what it's become: the biggest loophole, I think, in Australian healthcare history," Butler told the National Press Club. The Australian government will restrict flavours and colours, bring in "pharmaceutical-style" packaging, reduce the nicotine content, and halve the importation of non-prescription vapes.

The FDA has federal authority to regulate vaping products. In September 2020 the agency began reviewing Premarket Tobacco Applications (PMTAs), and has signalled it will not authorize flavored products without extraordinary evidence. Whether the agency will be successful creating an unwritten standard that eliminates legal flavored products (except tobacco and menthol) may be determined by federal courts. Most vape bans in the U.S. happen at the state and local levels. And while a few California cities—notably San Francisco—have banned sales of all vaping products, most American vape restrictions involve flavors and online sales. There are only a few of each, despite the large number of vaping bans that have been proposed in state legislatures in recent years—proof that grassroots opposition can stop bad legislation.
