The Canadian government has proposed the country’s first federal tax on vaping products in its 2022 budget. The vape tax, part of the proposed federal budget announced Thursday, would take effect Oct. 1—if it passes Parliament as written.The proposed tax is substantial, and includes an option for Canadian provinces to piggyback on the federal tax with an equally large assessment of their own. The national government is encouraging provinces and territories to pass equally large taxes, which would be administered by federal tax authorities.

The FDA has federal authority to regulate vaping products. In September 2020 the agency began reviewing Premarket Tobacco Applications (PMTAs), and has signalled it will not authorize flavored products without extraordinary evidence. Whether the agency will be successful creating an unwritten standard that eliminates legal flavored products (except tobacco and menthol) may be determined by federal courts. Most vape bans in the U.S. happen at the state and local levels.And while a few California cities—notably San Francisco—have banned sales of all vaping products, most American vape restrictions involve flavors and online sales. There are only a few of each, despite the large number of vaping bans that have been proposed in state legislatures in recent years—proof that grassroots opposition can stop bad legislation.

While public health advocates are frustrated as most PMTAs remain pending despite a September deadline set by the US District Court in Maryland, several anti-tobacco groups keep pressuring the agency to flat out deny applications for flavoured vaping products. With regards to the newly approved Logic Technology products, the FDA said that given that they are just tobacco flavoured, they may be less appealing to teens and could probably be of benefit to adult smokers seeking an alternative to traditional cigarettes. The agency added that their smoking cessation benefits to adults likely outweigh the risks to young people. Similarly, fifteen past Presidents of the Society for Research on Nicotine and Tobacco (SRNT) have recently published an article highlighting the importance of weighing the benefits of e-cigarettes against their risks, when debating and considering vape regulations.

The Philippines Senate today passed a bill that would legalize and regulate vaping and heated tobacco products, and eliminate the Philippines FDA’s authority over the products. The Vaporized Nicotine Products Regulation Act (SB 2239) was approved by a vote of 19-2, with two senators abstaining.The Philippines House of Representatives overwhelmingly passed a similar bill in May. The two bills will now go to a conference committee where they will be reconciled, and both houses will vote on the final version. Then the unified bill will go to President Rodrigo Duterte to sign into law or veto (if he takes no action, the bill automatically becomes law after 30 days).

The United Kingdom will be announced vaping products as the smoking cessation medical products officially.The UK has long been a leader in endorsing the use of safer alternative nicotine products for smoking cessation, and as a result the nation has the lowest smoking rates ever recorded since cigarettes arrived on the scene decades ago.Back in 2017 the UK government’s document released last Summer, Towards a Smokefree Generation, A Tobacco Control Plan for England, encouraged different localities to develop their own tobacco control strategies, with a focus on e-cigarettes and other harm reduction or smoking cessation aides.The British Medical Association supports these developments and has suggested that e-cigarettes are licensed as medicine, allowing doctors to recommend them to smokers trying to quit.
