The excitement of last week’s news that Malaysia intends to legalize nicotine vaping has been dampened by details of the finance ministry’s plan. The government is proposing a tax rate so high it would have significant unintended consequences.

The Columbus, Ohio City Council voted Monday to prohibit sales of flavored vaping products and tobacco, making it one of just a few major cities between the east and west coasts to do so. The flavor ban passed unanimously (7-0), despite strong opposition from vaping businesses and other local retailers.The ordinance will take effect Jan. 1, 2024, assuming Mayor Andrew Ginther approves it. On March 11, a new federal spending bill was signed into law giving the FDA regulatory power over synthetic nicotine, also called tobacco-free nicotine. Previously, the FDA only had the power to regulate products containing tobacco-based nicotine. Many e-cigarette makers, including Puff Bar, used this loophole to continue selling their nicotine-based products without gaining direct approval from the FDA.

A European Commission public consultation on the legislative framework for tobacco products is underway and will accept responses until May 16. The consultation—the second part of a process that began in 2022—launched in late February. While the consultation seeks comments on all tobacco products, it is clearly aimed at introducing harsher regulation for e-cigarettes and other low-risk nicotine products. Comments solicited will be used to shape changes to the Tobacco Products Directive (TPD) and possibly the Tobacco Advertising Directive. The consultation itself was deliberately written to elicit anti-vaping responses, according to sources quoted in a Vejpkollen story. But it is the only tool European vapers and other nicotine product users have available to prevent the adoption of prohibitionist vaping laws.
