On June 30, almost a year after Panama’s National Assembly passed legislation banning vape product sales, Panamanian President Laurentino Cortizo gave his assent to the bill. The new law prohibits sales and importation of all vaping and heated tobacco products, with or without nicotine. The law does not criminalize use, but bans vaping in any place where smoking is not allowed. The new law also prohibits internet purchases, and gives customs officials authority to inspect, detain and seize shipments. Resellers are allowed to import banned products meant for export to third countries, according to La Prensa.

Taxes on specific products—usually called excise taxes—are applied for various reasons: to raise money for the taxing authority, to change the behavior of those being taxed, and to offset environmental, medical, and infrastructure costs created by the use of products. Examples include taxing alcohol to dissuade excessive drinking, and taxing gasoline to pay for road maintenance. Tobacco products have long been a target for excise taxes. Because the harms of smoking impose costs on the whole society (medical care for smokers), proponents of tobacco taxes say that tobacco consumers should foot the bill.

Following a brief public consultation, the Dutch government has announced it will carry out its plan to prohibit vaping flavors other than tobacco, although the final deadline has been postponed for the second time. The new rules specify a very limited list of allowed ingredients. The rule will allow flavored products to be manufactured until July 1, 2023, and sold until Oct. 1, 2023. The ban includes both nicotine-containing and zero-nicotine e-liquids, and applies to bottled vape juice and pre-filled pods and disposables. The new rules also prevent manufacturers from using words or images on packages that refer to anything but tobacco, according to Dutch public broadcaster NOS.

The FDA has authorized marketing of two vaping devices and tobacco-flavored refills made by Logic Technology Development LLC, the vape product arm of Japan Tobacco International (JTI). These are the only vaping products authorized by the agency since Vuse Solo became the first in October 2021—more than five months ago. The FDA gave nods to the Logic Power and Logic Pro, and tobacco-flavored refills for both. Premarket Tobacco Applications (PMTAs) for both devices’ menthol refills remain under FDA review, as have nearly all menthol applications submitted to the agency. The smoking rate in 2022 among adult Americans dropped to its lowest rate since health officials began measuring it, according to survey results released yesterday. The decline came alongside an increase in the percentage of U.S. adults who vape. Preliminary full-year 2022 results from the National Health Interview Survey (NHIS) showed just 11.2 percent of adults smoked every day or some days. More than half as many surveyed adults, 5.8 percent, used vaping products every day or some days. In the fourth quarter of 2022, adult vaping prevalence reached 6.6 percent—the highest number since the NHIS added vaping to its survey in 2019. The results are estimates, and could be revised later. The NHIS is conducted annually by the National Center for Health Statistics (NCHS), a unit of the Centers for Disease Control and Prevention (CDC).

Several flavoured nicotine pouches have been recalled across Canada because they were not authorized for sale in the country. Health Canada issued the recall Wednesday for all lots of eight types of Zyn nicotine pouches. They were flavoured apple mint, bellini,black cherry,citrus, cool mint, espresso,original and spearmint. The pouches had 1.5 or three milligrams of nicotine in them. On Thursday, another recall was issued for eight types of nicotine pouches sold by XQS, containing four and six milligrams of nicotine.
